A Milwaukee police officer challenged the NBA player on January 26, 2018, at 2 a.m., because his car was straddling two disabled parking spots.

This happened near the intersection of South 27th Street and National Avenue, in a nearly empty Walgreens parking lot on the city’s southern borders.

A lot of cops came on the scene after Brown spoke with the officer, who sought backup.

Several minutes after the first police began conversing with Brown, a cop shouted at him to pull his hands out of his hoodie pockets.

The player stated that he had items in his pocket. He was then tased after being tackled to the ground.

Sterling was held on suspicion of resisting arrest. However, following an internal probe, the matter was not presented to prosecutors.

Follow Up On The Incident

After four months, the Milwaukee Police Department released a 30-minute video obtained by a police body camera.

Following public anger, Milwaukee Police Chief Alfonso Morales confirmed that the officers had been punished for acting “inappropriately.”

Brown described the episode as a “police intimidation effort followed by the unlawful use of physical force.”

The City of Milwaukee Common Council authorized a $750k settlement with Brown for the 2018 interaction with police on May 4 by a 14–0 vote.

Although there was no recognition of constitutional rights breaches in the settlement, there was an apology and acceptance of an unnecessary escalation notwithstanding Mr. Brown’s calm demeanor.

Officers involved in the activities have been suspended or relocated, while others have been required to retrain.

Furthermore, the agreement calls for a shift in police practices and develops a set of anti-racist policing standards and procedures that sanction officers who violate civil and human rights.

The deal also includes a new requirement that cops report every occasion in which an officer pulls his or her firearm.

Rejection Of The Settlement

Brown rejected a $400,000 settlement offer from the Milwaukee City Council in October 2019.

The high settlement offer was a legal maneuver aimed to abuse the Federal Rule of Civil Procedure 68.

Sterling is liable to pay the city’s legal fees and expenses under Rule 68 if he loses the action or earns damages of less than $400,000.

Brown stated that he declined the offer in part because of his skills and sense of obligation to use his NBA platform to promote awareness.

The player’s lawyer, Mark Thomsen, slammed the settlement offer, claiming it was the city’s attempt to save face rather than accept wrongdoing.

According to court records on November 27, 2019, a federal civil rights action is heading to trial.
